There is just one problem. We cannot evaluate and process complaints that come in for your website or app under the DMCA. So, what if you try to avoid DMCA complaints, but get one anyway?
Historically, our answer was to refer you to a book known as the DMCA Handbook. The book was written by attorney Connie J. Mableson out of Arizona and provided a plain English explanation of the law as well as the steps to take to deal with any complaints. The Handbook even came with templates and forms one could use to handle DMCA takedown notices.
But then something happened. Something unfortunate. Something horrific!
The DMCA Handbook went out of print.
No second printing of the book.
We were all forced to go cold turkey.
And it wasn’t pretty.
Suddenly, there was no go-to source for instructions on how to comply with the DMCA. Oh, odd sites such as Google tried to put out narratives, but lawyers often wrote them for lawyers with all the complexity that implies.
If you were lucky, you could occasionally find a used copy of the Handbook on eBay or Amazon, but capitalism was on full display. With the shortage of inventory came asking prices in the $250 or higher range. For that kind of money, you could buy an hour with an attorney to have them train you on how to handle complaints.
New DMCA Handbook
Well, I have some good news. After far too long, the DMCA Handbook is on the shelves again. Sort of. The first edition is still out of print, but Attorney Mableson has written a second edition of the book that is updated to reflect changes in the law and court rulings over the previous decade.
Now the weird part.
The new addition of the DMCA Handbook isn’t for sale at the usual locations. It isn’t on Amazon. It isn’t on Barnes & Noble. Nope, the only place you can find the new Handbook, for now, is on the American Bar Association website. The American Bar Association is an industry group for lawyers, but don’t let that frighten you. Attorney Mabelson wrote the book for small business owners. The price has been bumped up to $75 or so. Still, that’s a lot cheaper than dealing with a lawyer.
