What is the DMCA? The DMCA provides Internet-connected platforms such as websites and apps with immunity from copyright infringement claims based on content uploaded by users. This protection is known as the DMCA safe harbor. Facebook and YouTube use the law to avoid copyright lawsuits, and you can as well.
To gain this protection, you must comply with a number of simple requirements. One is the designation of an agent to receive copyright complaints. This person and their contact information must be listed on your website or app and registered with the Copyright Office.
You can act as the agent for your website or app. Nothing in the law prevents this, but most site owners prefer an alternative. The problem is the agent’s name, address, phone number, and email address must be listed with the designation. This information appears on your site or app as well as in the easily searched online database of agents maintained by the Copyright Office. At a minimum, you risk receiving a tsunami of email spam and cold calls. In a worst-case scenario, you might have unwanted critics or “fans” showing up at your home or office. Identity theft is also a never-ending threat. Given the risks, most site owners use a service such as ours.
The Copyright Office launched a new online DMCA agent registration system on December 1, 2016. The new system is much better than the old one, but comes with a few new rules that may be an issue for people working from home. Specifically, you must now list your “real” business address [no P.O. boxes or similar services] when registering with the Copyright Office as well as on your site or app where our agent information is listed. With our service, you receive the following:
- A person who will act as the agent listed on your online properties and in the Copyright Office agent database.
- We will receive and forward to you all copyright complaints filed under the DMCA for your online properties.
Please note that this service does not include evaluating or responding to copyright complaints. You must handle the complaints yourself using any of the online guides or by retaining legal counsel in your area.
We charge $70 a year to act as your DMCA agent and register you under our master account with the Copyright Office – about the cost of a couple of coffees a month. For this fee, we will:
- Act as your DMCA agent for up to a combined 20 sites or apps.
- Take care of the registration process with the Copyright Office for you.
- Pay the filing fee charged by the Copyright Office.
- Provide you with a DMCA form for your site or app containing the information required under the law.
Please note the fee covers up to 25 complaints a month across all your properties. There is a $10 surcharge for each additional 25 takedown notices received in a calendar month. For example, if your site receives:
- 25 complaints in February – no surcharge.
- 35 complaints in February – $10 surcharge.
- 55 complaints in February – $20 surcharge and so on.
We recommend that any site or app expecting to receive more than 100 complaints a month develop an internal DMCA compliance process and agent designation.
